In the domain region of realities—in politic the domain
of political economy, the existence of supply does not
follow, with with altogether equal facility and certainty quite so easily and certainly, form the
recognition of a want. Scarcity of corn does is not
immediately and necessarily productive of abundance.
But the empire of magnitude recognises no such difficulties: and
one of the most extreme and most provinces of that empire is the domain
of Common Law.
Seconded thus and fortified by imagination.
Necessity which even where there is law, is above
law, finds still less difficulty in putting itself in the
place of law, and making law where there is none.
