2. That the measures course or plan of operation chosen
by the said Mr Long for the accomplishment of
such his purpose was not any open lawful or honourable
course of action operation—such as that of an
application to be made to Parliament for the repeal
of the said Act—or a notification declaration openly
made either in and to Parliament itself or to
the other contracting party the said Mr Bentham
for the purpose of notifying to the parties concerned
that the said Act (although expressly stated and reported
by the Committee of Finance in their 28th Report
as obligatory) was not considered as obligatory by
the Lord Commissioners of the Treasury who if
any were the parties bound and obliged by it
—but an insidious and clandestine deceitful course of
action inconsistent with the principles of justice
veracity and good faith: a course of action
according to which the apparent and professed
intercourse should be all along throughout and on every occasion
that of carrying into effect the intention of the
law in respect of the setting on foot the said establishment
—which the his real intention being all along
so to order matters that the said establishment never
should be really actually set on foot: and that accordingly
by delays, obstructions and other as hereafter
set forth circumstances of the case should give rise
to, or afford give occasions to produce such plan of
prevention should all along be carried on and conducted
carried into effect.
