<p>The provision made by those dictates to which<lb/>
the <add>by the force of</add> legal sanction applies is in a high degree liable<lb/>
to be imperfect and inadequate: in so far as<lb/>
that provision is not condemned by the principle<lb/>
of utility it belongs to the popular or moral<lb/>
sanctions and for the most part the popular<lb/>
or moral sanction is not ill disposed to supply<lb/>
the deficiencies of the legal.</p>
 
<p>In relation to the point in question the <sic>diatales</sic><lb/>
of utility being supposed to be ascertained, the<lb/>
following seem to be the points in which the provision<lb/>
made by the legal sanction is liable to be inadequate:&#x2014;</p>
 
<p>1. By the legal sanction, no provision at all made:<lb/>
the legal sanction silent.</p>
<p>2. A provision made by the legal sanction but<lb/>
that provision contrary to the dictates of utility.</p>
<p>3. By the legal sanction a provision supposed<lb/>
to be made and that provision supposed to be not<lb/>
contrary to the dictates of utility but the import of<lb/>
it uncertain.</p>
<p>4. A Provision made and the Import of it not<lb/>
regarded as uncertain but the carrying it into effect<lb/>
rendered impracticable or more of less difficult<lb/>
by imperfections in the system of procedure<lb/>
That part which contains the rules of Evidence included</p>
<p>5. The existence of doubts or difficulties respecting the<lb/>
existence procurability, or import of evidence on the one side<lb/>
<note>or the other produced<lb/>
by causes other<lb/>
than the imperfection<lb/>
of the law.</note></p>
