The more apt an instrument of this sort would be with
relation to the purpose of the operation discussion function to which it applies
that purpose being a useful one, the more likely sure it would
be of being actually called into use and employed

In a legislative assembly, if in that assembly the only
proper end of government the greatest happiness of the greatest
number, in so far as concerned in the particular subject under discussion
were the object it to the attainment of which the exertions endeavours operations
of the members of the assembly were generally directed
the use of this as of every other safeguard against deception
would have place of course

So likewise in the case where the function is the exercise
of the powers of judicature.

But with the exception of some of the legislative Assemblies
of the Anglo-American United States, and in particular in
that of the Assembly the Assemblies of which the Congress
is composed, in no legislative Assembly has ever yet
been in existence, in which in the minds of the majority of
the members that only legitimate end of Government has been
or could have been pursued: for I speak not of those whose
character is not yet fixt, such as those of Spain, Portugal
and Naples
