Fraudulent obtainment

Qu. Is it Fraudulent obtainment to obtain the
loan of money upon false representations of ones
sufficiency to pay it?

Punishment ought
to rise with the
temptation.

To say that the punishment for an offence ought
not to encrease or rise with the temptation is as
much as to say in Mechanics that the moving force
ought not to be encreased in proportion to the burthen

I will state how I imagine take it these ingenious
writers came to fall into error if it be one.

themselves, at least we may shew within what
compass they must lie.
