Exemption — Consent [of the Sufferer.] Another ground of exemption is the consent of
the sufferer on whatever account given .

If a man consents to have an act performed upon
him, it is a plain sign that the sensation thereby produced although whatever it might appear to a bystander is
either not painful or if painful is attended by
a pleasure or appears likely to be attended with a negative good more than equivalent. Otherwise what
should him induced him to consent?

For this however to be the case , the consent ought
must have been free [; nor must there have been
on the part of the author of the act any industrious
purposed concealment of consequences known by him to be
probable.] and fairly obtained.
