(27 Observations Recognizance.

It were injustice to Dr Burn, not to take notice here, of
what he the advances he has made + in the forms he has recommended for a Recognizance towards the rectifying correcting this absurdity.
Instead The vulgar method of stating by itself the submission to
the penalty absolutely & by itself; and then stating by itself also the mode of
conduct, the observance of which is to exempt the
parties from that penalty, he has relinquished. He
connects the mention of the latter with the mention
of the former. He brings them into the same sentence. He
makes the cognizee submitt to the penal obligation, to the debt
not absolutely, but only "if he make default in
"the condition underwritten."

This it must be confessed is going a great way. Still
however the anachronism, the inversion of the natural order of
things remains uncorrected. The penalty which in the
natural order of things does not take place till
after the transgression, is mentioned first as if the infliction
of it were to precede the offence The penalty is first
mentioned and then the offence. The natural way is
first to mention the offence, and then the penalty.
For that which first exists it is nature should naturally be first
mentioned. Now certainly in point of fact it is the penalty offence that
happens first exists, and then the penalty. It is First comes the cause
that happens first, and afterwards exists and then comes the effect.
