Probity in a Judge is no otherwise farther of use than in
as far as it helps contributes to insure rectitude
of decision: inprobity, no otherwise than of
no otherwise than in as far as it has the contrary
effect. The duty of a Judge judging on the question of
fact is to decide according to the evidence. Being Not
a Judge only and not a legislator he has nothing
to do with the propriety of the law. If there be
any instances in which a Judge is habitually
by the influence of any principle in the practice of deciding contrary to the evidence
that Judge shows himself radically unfit for the
exercise of his function: whether the principle that
governs him determines his conduct be termed improbity or
corruption, or by any name or less obnoxious
name is but a question of words. Let it be humanity
love of liberty, piety, call it by any other still
more reputable name if you can find one, the
effect in this point of view is just the same.
