Inferenda Observations
pay the penalty of it; [to be prejudged his trade] for three
years, to be suspended from his livelyhood. For three
years absolutely. Neither can any part of the penalty
nor any part of the time of the disability
be tted. Thus if a set of the parties in a Division have
happen'd to adopt those regulations concerning hours which
Dalton and after him D'Barn have recommended,
a man may in the 1t placebe made to pay £10, and twice
£5, and costs to an amount not to be conjectured,
in the 2d place he may besides be deprived of his
livelyhood for three years for not turning his customers[suffering customers to
continue] out till 1/4 after 9 instead of 9; or though
it were in the middle of the day, for letting them stay a few minutes over the hour that
is to be allowed them.
As to the latter part of the punishment one may ask
why nothing else will serve the turn, than the depriving
the man of his livelyhood: and if of all the acts
by which a Publican's recognizance can be forfeited
although it is more than any man can do to say what they are it
is thought that there is no one for which he ought not
to be deprived of his livelyhood, why in words it should
be taken from him only for a time: as if a bus-ness
