INTRODUCTION. Principle of Utility the Test of MAXIMS.
The grand complaint against maxims especially
in Jurisprudency is their laxity & want
of precision — Either they have no precise sense,
that is in the several sorts of cases to which they
apply & those to which they do not apply are not [certainly] assignable: or if
they have, that is, if those several sorts of cases are
assignable, it is too large: that is, in some of the assignable [those] cases the
maxim is not true.
