Were the ends of Punishment effected attained as
effectually, and at as little expence by
supposing chasing any other object as well
as the offending party, there would be nothing
to say against that such a choice.

Punishment however is conceived to belong
as it were to the party committing
the obnoxious act, to exclusion of all others:
where any other is chosen for the object:
such other is said to suffer in the offender's
stead: the Punishment is called Vicarious
Punishment.

Punishment, is conceived I say, by the
generality of men to belong be appropriated to the offenders.
They feel a repugnance at the thoughts
of its being transferred imposed on any one else.
