<p>To refuse the Contractor the benefit of the <hi rend="underline">valeat</hi><lb/>
 
<hi rend="underline">quantum valere potest</hi> &#x2014; would be inconsistent (as already<lb/>
observed) with the undertaking in this behalf apparent<lb/>
on the face of the draught. Such being the terms,<lb/>
on the faith of which he has laid out his money, if<lb/>
those terms could not otherwise be carried into effect,<lb/>
Government would therefore stand bound (he conceives)<lb/>
in point of good faith, to apply, at his instance,<lb/>
for a fresh Act of Parliament to overcome the difficulty.<lb/>
He is content at his own rush to waive the<lb/>
putting of them to any such trouble: but under that<lb/>
circumstance, surely, the least they could do would be<lb/>
to give him the chance he prays for.</p>
<p>The refusal would be an injustice in another point of<lb/>
view: it would be making the <hi rend="underline">individual</hi> a sufferer by<lb/>
a defect <del>of</del> which was the act of <hi rend="underline">Government</hi>. The<lb/>
Act of 1794 was penned in great haste, to save a<lb/>
Session which was on the point of being lost by delays<lb/>
on the part of Government. It was penned by the<lb/>
Agent of Government &amp; from imperfect instructions:<lb/>
no sufficient opportunity having been given to M<hi rend="superscript">r</hi> B<lb/>
to say how far it quadrated with his conceptions. Being<lb/>
