What then is the proper end of punishment?
the proper object purpose object which punishment
ought to have in view? the same which
is the proper end and object of legislation.
What then is the end of legislation? the
promoting as much as possible the production of the greatest possible happiness in
the community of whose interests it takes charge.
This end main or universal end of legislation may
be consider'd as branching itself into two immediately subordinate ones: : the
one positive; consisting in the production of all as
much good as possible: the good that can be produced by legislation:
the other, negative; consisting in the avoiding
to produce any evil that is not over-balanced or
by the good necessary to the production of
a more than equivalent share of good.
These then are the ends of legislation. But punishment is not the only instrument
it has to work with. It has two other instruments:
on the one hand physical co-ercion:
on the other hand, reward.
