1. Reduction of the number of Jury persons taken to
compose the Jury in each cause.
The consecrated number, twelve, has not a grain the
shadow of a reason a single grain of utility
to recommend
it.
If pretended unanimity be exacted (a state of
things which I can not bring myself to think of
as so much as possible without pain—)no reason
has ever been given why ten, eight, six, or
four might not serve as well: if variety be allowed,
no reason why, a majority being now the
object, eleven, nine, seven, five, or even three might
not suffice.
