1. Reduction of the number of Jury persons taken to
compose the Jury in each cause.

The consecrated number, twelve, has not a grain the
shadow of a reason a single grain of utility to recommend
it.

If pretended unanimity be exacted (a state of
things which I can not bring myself to think of
as so much as possible without pain—)no reason
has ever been given why ten, eight, six, or
four might not serve as well: if variety be allowed,
no reason why, a majority being now the
object, eleven, nine, seven, five, or even three might
not suffice.

Admitting for argument sake, there to be a
number sufficient for causes of small the smallest importance
it would not follow (it may be said) that it this small number should be
sufficient for causes of the greatest importance. If in Some
provision, it may be added, will be necessary, for making
the number of three Judges rise, in some proportion in
line with the importance of the cause.
