Indirect Legislation

Satisfying

In the draught I have proposed of a penal
code are satisfaction is uniformly given it as
far as there is wherewithal, to whoever has sustained
received injury: nor is the title to it renderd
defeasible for by any such contingencies. The reasons
for this are there display'd at large. See Princ. of Legisl.
B. I. Tit. Com [Satisfaction]

Considering how defective the laws in general
are as yet in this particular, one would almost wonder
at the facility with which men in general
consign over make a sacrifice of their resentments to the law. This
may be attributed in some measure to that vast
and enormous source of universal mischief and
accidental benefit, the men's ignorance of the law: partly
but principally to the care which is taken to
provide punishment at least, which administers
a satisfaction of the vindictive kind in default
of lucrative. The law, while it neglects to give
them the sort of satisfaction care redress which would be
most competent to their case, gives into their
weakness, and administers to them that improper less apposite
species of satisfaction, which in the blindness of
their resentment they might be tempted to imitate
administer to themselves.
