21 Jany 1812 §.1 + + 1
Evidence Ch. 9. Extra False Security — Oath
1 §.1. Why false

☞ 23 March — Insert as a last section in Ch. 9, an
abridged view of the reasons for regarding Oath as a false security:
for details referring to the Appendix.

Ch. 9

False security for trustworthiness, Oath — the called
an Oath.

§§ 6. False — an epithet why here applied.

1
The exercising
actually employed was
generally conceived
as a fit security,
but not justly.

In the character of an instrument actually employed,
which, under the notion of its operating as a security — be the occasion purpose in question
a fit and efficient security, is actually employed the title of this
to a place upon the above list of the securities admitts not of is not spread by admitts not of
dispute. But, in the character of an instrument fit
to be so employed, the more closely it is looked into
the more plainly, it is supposed, will its unfitness to
be so employed, be recognized.

From the ceremony itself, taken by itself, no security —
no benefit in any shape — it will be seen — is
derived. mischief will be seen to be the character of its produce.
The benefit, whatsoever it be, which in appearance
is derived from this source, is in reality,
(it will be seen) derived from the form punishment, from shame, from any
thing but from oath.

If it will be seen, derived from the fear of punishment,
from the fear of shame, from the hopes and fears that
religion inspires without the aid of any such factitious
instrument — in a word from any thing but oath.

is it in the nature of things man that to him who is to suffer it, by any
such circumstance should make any sen any difference or sensible difference should be made?
Yes: Possibly: if that man be any where to be found, who had chose
rather to be made to pay £6 by means of evidence of any
sort than £5 by means of
rather than pay be made to pay
£5 by means of evidence of this sort chose rather to be made to pay £6
by any other sort of evidence.
