A Benefit - May be enjoyed
either without - or
only through intervention
of Judge, if an efficient
Cause of right has occurred
in my favor, and none of
cessation of right - Every
thing in the Civil Code,
except Procedure, comes
under one or other of
these heads.

Subject matter of right
susceptible of numerous
diversifications; ingredients
of which a cause may
be exposed, also numerous:
as in an Election

Out of one subject matter
right may arise in
any number. Your coal
sold by Taylor, and then sent
to Foreign country - these
efficient causes of cessation
of right, but at same
time arises a right to its
value, in money.

So in case of a proniuit
fulfillment is imposible
by the promiser
- here is cessation of -
right to it, but commencement
is given to another
namely - payment of an
equivalent sum of money.

So a Bill of Exchange
passing from hand to
hand

All that is material to
Know is the state of the
causes of commencement
and cessation of right, at
the charge of the persons
in question, the procedure
before the Judge, supposed
to be the same in all cases.

All this may be said of
burthens; they being indispensably
attached to benefits
and rights - this burthens
may exist without benefits
to any one.

In this case obligation
must be substituted to
right.
