Hodges Counter Agreement
March 1800.

Memorandum of a Counter—Agreement or Contract bearing reference to a
Contract or Agreement of this same date between the parties hereunto viz:
Benjamin Hodges of Millbank in the Liberty of Westminster Distiller and
Jeremy Bentham of Lincolns Inn Middlesex and Queen Square Place Westminster
Esquire.—

N.B. The Sums herein inserted
in Pencil being put merely by
way of example no regard
whatever is to be paid to their
amount. But the amounts
as proposed by Mr. Hodges
are desired to be inserted in July

Whereas in and by the said Contract it is agreed that if the said
Benjamin Hodges his Executors &c at the requisition of the said Jeremy Bentham
or his Successors shall quit the premises in that behalf mentioned on the
25th day of this instant March then and in that case the said Jeremy Bentham
&c shall pay and the said Benjamin Hodges &c shall accept the
Sum of £4750+ in full satisfaction as well for the right and interest of
the said Benjamin Hodges in the said premises as for all damage which may
accrue by reason of his quitting the same on the said 25th of March. But
that if the said Benjamin Hodges &c shall have been permitted to retain such
his possession until the 29th of September next ensuing then and in that case
the said sum of £4750 shall be reduced to the sum of £300 in manner
as therein mentioned.—

And whereas it may chance not to be necessary for the purpose of
the Act of Parliament in the said Contract mentioned that possession of the
said premises should be quitted so soon as the said 29th of September next ensuing

And whereas it may eventually be in the power of the said Jeremy
Bentham &c without prejudice to the said purposes of the said Act to permit
the said Benjamin Hodges &c to retain his or their possession of the said
premises down to the several days hereinafter respectively in that behalf mentioned.

Now therefore it is hereby covenanted and agreed by and between the said
Parties that if the said Jeremy Bentham &c shall permit the said Benjamin
Hodges quietly to retain until the 25th of June 1801 his possession of the premises
