Art. 23. And whereas forasmuch as every such quondam Penitentiary in virtue of the divers provisions herein of above
contained every quondam Penitentiary Prisoner will
according to the option election he had made have
been provided with some instrument expressive of demonstrative
of his discharge from the said Penitentiary House, and expressive
of the service in which he isstands thereupon stands engaged; his to wit either
his copy of Metasylum Service Engagement, his copy
of the Assignment of Wardship, his Certificate of
Discharge and Intestment, as the case may be: as also
if absolutely emancipated his instrument of absolute
emancipation accordingly in consideration thereof Therefore
In consideration thereof and
for the farther and more effectual prevention of escape
and desertion of service as aforesaid Be it enacted
that any person marked with an any such identification made
as above mentioned (Sect. X) and not being able to produce some
such instrument as aforesaid, the same being also
according to the nature thereof
within date and unexpired, shall⊞ ⊞ unless it being within the term of such instrument's being in force be this purpose
(unless he having had such proper virtue and as approved
unless such instrument should appear to have been while annex
instrument the same should appear to have been by
any accident lost or defaced) be deemed prima
facie a fugitive from the Penitentiary House, or a deserter from his service at the Metasylum, to the
purpose of his being liable to be apprehended as
such by and conveyed to the said Penitentiary-House
as herein after specified.
