under temptation to commit wilful Perjury, And
Whereas the ordinary punishments for Perjury
being calculated for the condition of persons at large would be
unsuitable to that of a Penitentiary man and
might have the effect of transferring him to
some other Prison less not so well adapted to his situation
as the said Penitentiary House and require a mode of
prosecution attended with such formalities expenses and
delays not necessary as would not be in the present instance
would not be necessary Be
it enacted that if any Penitentiary man should Prisoner, who
in the course of such his or her examination shall be
guilty of Perjury and thereof be convicted in
the Penitentiary House, may be punished with
whipping at the discretion of any two or more Justices:
of the think that one Justice at least who were
of whom a Justice ⊞ ⊞ on which occasion such Justices who were present at the taking of such
examination ought of are not, or at least some one of them as is is, hereby required
to be one to attend: provided that for the no
such proceeding shall for want of any such attendance
be void.

Any Penitentiary Prisoner who on the course
occasion of such examination shall refuse or
wilfully forbear to make perfect answer to any
fit questions may be punished with whipping
