C- Punishment analysed into its various possible modes

has a mind to do. The punishment in both these cases may be stiled restrictive punishment. Constraint may also affect him in two ways. 1. In his passive powers, by causing him to suffer what he has a mind not to suffer; in this case the punishment may be stiled passive punishment. 2. In his active powers, by causing him to do what he has a mind not to do: in this case it may be stiled.

Note. it that any attempts were made to accommodate it to philosophical disquisitions: and for the purposes of common life there can seldom be occasion to make any distinction between two states so intimately connected as that of suffering pleasurably and enjoying. As to painful sensations they come upon us but too fast of their own accord; but pleasurable ones can scarce be experienced without some degree of activity. At any rate if the first moment of pleasure finds us passive the second makes us active: the pleasure of itself being commonly enough to dispose us in some sort to activity for the sake of protracting and increasing it. Music unexpectantly strikes my ear: for the first moment I am passive; but if it is agreeable to me, I immediately apply my faculties in an active manner to attend to it. A fine prospect meets my eyes: for the first moment I am passive, but if it give me pleasure, I immediately set my eyes to work to investigate its beauties.
