Constitutional Code. 2 Enactive Part
Ch. Judiciary collectively
S.1
16
A Difficulty presents
itself the vexation
& expense unavoidably
attending the pursuit
as well as defence of a
suit
But here at the outset a great difficulty presents itself
To those who for this purpose are which upon to pay attendance
on a Judge, the obligation of paying such attendance will
unavoidably be productive attended if execution or expense or both
to an indefinite extent. On the other handTime it is that at the
time of it be matter of vexation to be obliged to be attendant
at a in the character of Defendant
so<add>such to a certain degree</add>it can not but be alarmed at that some place in the
character of the Pursuer But a state of things which
to an indefinite extent may leave places is this - namely
that which to this or that man in the character of defendant
attendance for the man is greater is a very se evil
to this or that man in the character of pursuers it shall
be no such evil: on the contrary, when emptied with the
benefit expected in this or that shape from the evil to
which the defend is this subjected in from the re of
it, it may in his eyes be a good: and such will
as for in where the suit him for its effect the obtaining ex from the an independent defender property in some shape or other
ility
by an unjust claim, by means of his inability through
indigence to employagainst it the necessary means of self defence
or more simply for the gratification of vengeance reducing him by for means
of the expence to a state of indigence.
Such being the state of the case
17
Thence the entering in
a suit the means of
inflicting evil on the
antagonist
Hence it is that if without exclusion or restriction
the door of the judicatory is thrown open to all the ally is giving individual
in the character of pursuer, implied with the function to compel none
of those the attendance of persons of every condition in any
number to meet him ther in the presence of the Judge
in the character of defendants, and no restraint is laid
upon the above of this faculty, the power of Judge may by means of
the official services may by this means be rendered at the
of may evil doer if any number of evil.
, by rendered how ingly so was the instrument of evil to any amount.
