when but for suppression

art. Evidence suppressed is either
evidence, which, but for the suppression, the suppressor
himself would have produced, or evidence,
which, but for the suppression some other person
would have produced.

Deception are instrument
of evil in all offences
but setting aside evil
consequences deception
of itself no offence

no offence exists or is imaginable,
in the commission of which deception,
in some form shape or other may not be made an
instrument; but, setting aside all evil consequence,
deception is neither evil nor pregnant
with evil, nor nor accordingly, ought to be dealt
with on the footing of an offence.
