Amount of vexation

As to the quantity of vexation necessary attached
to the situation to in which the defendant must be placed in
order to secure on his part the compliance necessary to
the adduction of evidence on both sides the maximum it will in general
be comparatively inconsiderable: restraint on his liberty
of locomotion during the time necessary for the adduction of
the evidence on his side is the time at the end of which<lb?>the pursuer will have adduced the whole of his evidence
or in failure of it suffered the dismissal of his demand:
of those time passed the longest which so ever it may be

be, evil consequences of the most permanent in
duration as well as magnitude to an indefinable degree
may in such cases be included. Of those two
