one from this Board, respecting M<hi rend="superscript">r</hi> Bentham's Memorial<lb/>
 
for an increased Charge in the Terms of his Contract, for<lb/>
 
erecting a Penitentiary House, wherein M<hi rend="superscript">r</hi> King states, that<lb/>
under the present Circumstances of the Colony of New South Wales,<lb/>
the Duke of Portland conceives, that at no very distant Period it<lb/>
will be in such a State of Improvement, as to be capable of<lb/>
receiving in each year the whole Number of Convicts which it<lb/>
may be necessary to send from the different Gaols in the<lb/>
Kingdom;  and that his Grace concurrs in Opinion with my<lb/>
Lords, that the Plan, if adopted at all, should be to a limited<lb/>
Extent only;  but with respect to any Compensation being<lb/>
made to M<hi rend="superscript">r</hi> Bentham, his Grace leaves it to the Determination<lb/>
of this Board.  And should their Lordships decide upon its<lb/>
being adopted on a limited Scale, his Grace conceives that a<lb/>
Building large enough to contain 500 Convicts will be sufficient.</p>
<p>Write to M<hi rend="superscript">r</hi> Bentham, to know under what Terms<lb/>
he would be willing to contract for building a Penitentiary<lb/>
House for 500 Persons, and for maintaining them, if that should<lb/>
be resolved upon;  and if upon Consideration of that Proposal,<lb/>
the Plan should be relinquished altogether, my Lords desire<lb/>
he will inform them what Compensation he conceives himself<lb/>
entitled to for his Expenses and Loss of Time in preparing for<lb/>
the Undertaking.</p>

Read Letter from Mr King, dated 17th Instant, in answer to
one from this Board, respecting Mr Bentham's Memorial
for an increased Charge in the Terms of his Contract, for
