the work of the legislative – the Constitution<lb/>
is at an end.</p>
<p>The Act<hi rend="superscript">⊞</hi> <note><hi rend="superscript">⊞</hi> the Penitentiary Act, in prescribing the part to be taken by the Treasury in the institution of an Establishment</note> says required – The Finance Committee<lb/>
taken notice of its having said required<lb/>
– and <del>up</del> after this my Lord – and after I<lb/>
had told him of this – his man in office<lb/>
had the effrontery <add><gap/></add> to maintain to me <add>insist upon it to my face join me</add><lb/>
that it was <add>and always was and could be</add> in their power to do it or<lb/>
not to do it – as they pleased.  My Lord<lb/>
I know it – and know it but too well, it<lb/>
has been so by abuse – but if that abuse<lb/>
is to go on – and <unclear>precedents</unclear> are to be made <add>to stand in the eyes of the<lb/>
<unclear>public</unclear> and of Parliament as a <unclear>precedent</unclear></add> from it the Constitution is at an end.  For<lb/>
me Lord if for argument sake it should<lb/>
be the pleasure of Parliament to bind the Treasury<lb/>
by what plainer words could they<lb/>
go about it <add><gap/></add> at it?</p>

My Lord if the pretence of seeing in an Act
of Parliament what is not there is to be allowed
– and on under colour the strength of that pretence men are
to be suffered to be turned into wash paper
