To the malâ fide suitor whose station in the cause is on the defendant's
side of the cause, the delay is capable of being made to serve in
the character of an instrument of mischief, in the several all
ways, as above described, in which it is capable of being made rendering
like service on the plaintiff's side, and moreover in one
way shape which is peculiar to the defendant's side.

This peculiar advantage consists in his continuing
in the possession of the article of value, whatever it be, which
is the subject of the plaintiff's demand.

If it It may be an article productive of increase in the
natural way, such as a lot of productive land.

It may be an article productive of increase only
through the channel of a convention, as in the case of rent of
land or interest of money lent.

It may be an article productive of benefit without
increase, as in the case of a house in the occupation of the
owner, or a beast of burthen applied to that case.

In these cases of this sort it (not to speak of the more
refined benefits and enjoyments attached to social connections, such
as those attached to the condition of husband and wife, parent and
child, guarding and ward, or even master and bound servant) the shape
in which the advantage presents itself is commonly either those of
interest of money, or profit in trade, taken in the largest sense of
the word trade.
