As to the physical subject matter of the offence
it is in the present case, the object initiated
the description of it is very different from what it
is in the case of many and indeed most other
species of delinquency crimes and misdemeanours. It is not the substance
– the mass of matter on which the physical
acts in question are exercised: it is a very different
object – a mass of matter for with a view to the imitation
of which those acts are exercised. It may by
accident indeed be the genuine coin as well as the spurious:
but whether it be or no makes no difference
in regard to the mischief, or in any other way
in regard to the demand for punishment. An accident
of this sort has no other effect than to give
a rarity to the description, and to necessitate the
insertion of an additional species in order to make
the list compleat and exhaustive.
