12 C Of Simple Personal Injuries Reasons. Quest. VII VI

Why binding to good behaviour is made an article
in the punishment ?

Reasons

1. In order to guard obviate and subdue any
designs which the offender might entertain of
swinging himself upon his adversary for bringing
him to punishment.

Quest. VII.

Why banishment from the presence of the
party injured is made an article in the punishment

Reasons.

1. In order upon occasion, to provide the more effectually for the
humbling of the offender.
2. In some cases in order to save the party
injured from future sufferings. [+] [+] The quantity of mischief liable to be produced by Offences of this
sort are is infinitely various. No tortures so
excruciating but may come under this head.
In such cases it may well happen that the
sight of the offender shall for a long time or
even ever after be insupportable to the party
injured. If one of them then must take himself
away, it is better the criminal should
be put to this inconvenience, than the his innocent
antagonist whom he has already injured
in so severe a degree. To p. 2
