§. 1.

— account. an action of account or a bill for
account, no matter the name by which the judicatory
calls itself, which is it? It is an aggregate compound
of as many different suits as there are items in the account
on the pursuer's side, which may be, is, that
not one of them will be contested; what frequently
happens is that only a small part of the whole
number is contested; but what may also be, is,
that, whatsoever be the number of these ends they
amount to, every one of them will be contested.

An observation that may here be made is,
that on the occasion of the sort of proposed reconciliation
in question, this almost infinite mass
of compleation is not a mass with the
mass above spoken of but a mass, which may
its of but a portion of that same mass.
The observation is true that no practical result
follow from it to judge of the weight of the first
mentioned objection, to take on one ride pat part an action
of account and on the other part an action made a
of suits having for its object, wrong in every other
shape except that, which consists in the non payment
of a debt due upon an account as in the case of
the suit on the sense of account the compleatedness
is never regarded as a sufficient reason for withholding
the remedy, much less would it be, for withholding
it, in the case of a mass of wrongs, including
the wrong consisting of the non payment of debt due on account.
