Ch. Communication Means of execution
§, 3 – immediate and preparatory

Means of communication are alike necessary to the
obtainment of all other means of execution: of all means of
execution in any of the all the several shapes abovementioned: persons, things
initiating and other discourses: in particular all judicial instruments.

In regard to means

In regard to means of communication concerned
in every instance on every occasion are 2 1. the occasion. 2. the purpose. 3. the subject matter. 4. the agents
3. occasion.=s 4. purposes 3. The subject matters are the persons or things communicated or person and things of which or from and to
which the communication requir comes to be made.
4. Agents are the persons or things or person and things
by the whose agency of whom and which the communication is
effected.

Distinguishable on this occasion from things at large
will be those things which serve as instruments of discourse.
the occasion and purpose considered being in every instance kept in view, those thing are here designated appropriate things will
here be designated distinguished by the aggregate denomination of judicial instruments.
As to these, see Ch. Judicial instruments.

Art. As to the occasions on which the communication
may cause or require to be made, they will present
themselves to view as the several events and operations that
may come to have place in the course of the suit in question
come to view.

So in like manner the purposes, and the matters belonging
to the several heads above mentioned.

Art. In to the means of the class, as with the existence
as the degree of aptitude and sufficiency will in every political
state and every each portion of its territory depend upon p
partly upon and in one upon natural, partly upon human
agency: in a permanent degree upon natural: witness soil, mountains,
seas, lakes, rivers.

Not small accordingly are the varieties which on their parts
they can not but exhibit in different territories and under different governments.
