instead of dealing with one thing at a time.

If in this case one of the parties contends to have that the
prize the prize sold, and the other to have it remain unsold,
what in that case is to be done?

So again if each of them contends to have it
delivered for that purpose to himself, deprecating its
being for the like or any other purpose delivered
to the other his antagonist – what in this case is the to be done by the Judge
to do?

To neither of those questions can I venture to give
an answer in any other than the legislator's own
words: – "in such case, the Judge of such Court of Admiralty
"or Vice Admiralty shall and may" (says he) "at the request, costs
and charges either of the Captor or claimant (or" does this
mean but?) of the claimant only in a the case where the privilege
is reserved in favour of the claimant (does this
mean to the claimant to the express exclusion of the captor?)
by any some treaty or treaties subsisting between his Majesty
and foreign powers) make an order to have such
capture appointed, unless the parties shall otherwise
agree upon the value thereof, and an inventory" to
be "made, and there take security for the full value
thereof accordingly, and thereupon cause such capture
to be delivered to the party giving such security in
like manner as is hereinbefore enacted, notwithstanding
such Appeal; ....
