If a pretence were ever made of on the occasion of
such selection anything recourse were ever made to anything
that could be given as presented in the character of a principle – a publickly avowable
principle or ground of decision, it would be so much
the worse. The principle would be this – viz. that
the causes in which he thus declines pronouncing a decision
are those in which in his judgement at least,
the task of pronouncing a decision is attended with the greatest
difficulty.

But if there be one description the passing under
the review of two different judicatories a second judicatory be of any use or not a security against
of any use or value as a security against misdecision,
and if there be one description sort of cause to which more than another
stands in need of this security is necessary, it is the more difficult
