G Instruments to the Legislature

To this head will be seen to belong two sorts of Judicatories
which are in use to be instituted in operation for two purposes
which however different in denomination agree in their
most characteristic and distinguishing attributes.

1. Of those common characteristics the principal one is
and that an effectual one is this – on the occasion of the
enquiry carried on between the parties party and party on the opposite
sides opposition of interests antagonization on the field of interests has place,
but not, unless by accident, actual contestation.

2. From this principal characteristic attribute arises another
which accordingly may be termed a derivative one. The
