PUNISHMENT C. Measure 1

It is a very a true just observation adopted in the Commentaries
from Montesquieu, that It the certainty of punishment is much more effectual than the
intensity of it. the observation State of the Police in France of the French Police may at
first sight perhaps seem to disprove the justice of this
remark. There are a species of crimes, Highway- -Robbery for
instance, which in no country are more severely punished,
and at the same time are in no Country less frequent.
But at the same it must be allowed if the severity of punishment there is great, the certainty
of it is no less so: and it is to this latter circumstance
I would rather chuse to attribute the effect. It is an
error we are very apt to run into, to mistake a circumstance
accompanying a cause for the cause itself. But if an
instance can be produced where, that circumstance standing
singly, no such effect is produced, that will sufficiently
prove [it not to be] we are to look elsewhere for the cause. It is well known that in
France, the protection of the roads instead of being trusted
to the uncertain operation of gain upon the mind of the
first man who may happen be in a situation disposition to pursue
the robber, but who may have that disposition checked by a thousand doubts and difficulties or the phantom of the posse comitatus
as with us, is made the regular and almost only occupation
of the numerous military who in time of peace
are distributed so plentifully throughout that Kingdom

if the end were not very effectually attained. An end indeed the attainment of which We in this
