Attornies presumptions
1
From diverse sections more than one it should seem that in
Mr Broughams view of the matter presumption is in some
one or other of the four modes spoken of by Aristotelians
He prop of one Attorney: in such sort that in
every press is poor, and every poll pretty i e every
Attorney is presumptuous. Accordingly presumption
in a presumptuous fit he catches his Attorney in §.22
and in the like fit in §.36. In §.22 he beholds then an
Attorney presuming "to change his with any
"critical to be point by himself made to authority of this
"Act." and again presuming "he preaches, desiring his suspension."
In §.36 what he catches the Attorney in presuming to
do is "taking more by way of fees for work done by him than
"those according to the Table" contained in the Schedule
There we see our honest Legislator in the character of
a disciplinarian Yes and thus an unprecedentedly severe
one: awful must have been the frown sitting that sat on the
brow of this Lycurgus with while occupied in the penning
of these two clauses sections. Hold up your heads matchless
Gentlemen sole remaining Gentlemen remaining on
English ground all others being transformed into
Scholars or Esquires. Hear then the words of comfort
we have provided for you. 1. Consolation the first. In the first place, you
have no existence any of you.[+]
[+] such it is a proposition
his due
in the character of a
is — He that lacks an
existence, can not be
made to suffer punishment.
Scholars yes in
plenty — but of Scholars nothing is said in this Act
This consolation applies to both these appalling Sections.
2. Consolation the second.
2. Then in §.36. severe as is the prohibition applied in regard
to excess in that which is "taken ... by way of fees, it
extends not to any money taken by way of gratuities:
to which word not enough might be added recompense
reward [ ]
remuneration compensation : matter for which see Johnson's Dictionary.
