Art. 1. Antecedently to the decision of the quest
Art. 1. Fundamental State. To the government
on behalf of the public it belongs to Antecedently of
the decision as to the question whether any party is in the
wrong, and if yes who, and in what way and to what
extent in the wrong, to the government, at the charge of
the people, for the benefit of the people in their eventual
capacity of suitors, to take upon itself the burthen of
costs, even though by from its so doing the aggregate amount
should in some degree receive encrease. But this will
not be found to be the case. ☞ For the rationale see

Art. 2. Upon every party in so far as he
is in the wrong After minimizing as above the amount burthen
in so far as it can not but rest on the parties one or
more of them, as with the endeavour of the legislator will
be to station it upon the each party or parties to an
amount being in proportion to the degree in which he
is in the wrong or say to blame or blameworthy &, regard
being had to the distinction between blamelessness, rashness
and evil consciousness.
