§. 7. Postulative function.

Art. 1. In chosen cases – in which for engaging
Art. 1. Postulative or money craving function. For engaging, at the hands of individuals, service
in various shapes necessary in this or that shape, to the giving execution and effect
to the law, and in particular in the shape of evidence, reward,
at the hands of government will, be in various shapes cases be found necessary: and in divers of
those cases the either the quality or the quantity of the reward
will necessarily remain unfixt by law. By the exercise of this
Public Pursuers particular function, this the deficiency thus left will, to a certain extent, so far as government is interested be
filled up. At In each Immediate Judicatory, the Public Pursuer
will, in each individual instance, indication being given of the service needed make postulation to the
Judge: proposing the quality, commonly pecuniary, and in
that case and other cases the quantity, of the reward, to be
in that same instance allowed, upon as occasion, calls, proceedings
for this prupose will have place as per Art. 3.

Art. 2. Cases for in which exercise may be given to
this function are, as above 1. Cases Non-penal in which cases in so far as government is a party.
2. Penal cases, purely public.
3. Penal cases, purely privateppublico. private
