§. 1. Evidence (judicial evidence) in general – consideranda division of the subject

Art. 1. In regard to evidence, the following are
the subjects that require to be considered – the following
the heads under one or other of which the whole
of the matter belonging to this subject indicated
by this all comprehensive term may be arranged.

1. Why and how far needed.

II. Subject Evidence – its subject matter – facts of all sorts

2. Qualities desirable in it

2. Evidence – sources from whence it is desirable

4. Shapes it wears in each source

5. Evidence – its sources – how to obtain access to this
respectively for the purpose of checking the evidence
respectively derivable from them.

6. Deceptiveness or say fallaciousness on the part of evidence
its modes. Evidence is fallacious, in so far as the
conclusion drawn from it in relation to the facts in question
is erroneous. Of this quality the modes will be different exhibited
differences corresponding according to the difference as between source and
source.

7. Deceptiousness its causes in regard had corresponding to the case of the different
modes.

8. Elicitation – modes of effecting it (the sources being
within reach) no such manner sort as to obtain it in
possession of the several qualities desirable in it

9. Probative force – how to for take measure of it – how
to give expression to the degrees of it

10. Probative force – how to form a just estimate of it,
regard had to the modes and means of deceptiousness
or say fallaciousness

11. Evidence – proper causes of exclusion delay
vexation and expence – duration of – vexation of disclosure.

12. Improper causes of exclusion – danger of deception – vexation in certain cases.
