From the appellation thus bestowed upon offences,
consequences of such prodigious vast importance in practices are
continually resulting, that in the present Code the use of it being requisite a determinate
import will all along be given attached to it: such is the
manifest unquestionable dictate of the greatest happiness principle.

An anti legal A crime is accordingly an appellation by which
is designated a misdeed accompanied with evil consciousness:
consciousness to wit in the case of a legal crime
that the act is of the number of those which stand prohibited by the legal
sanction: in the case of a moral crime of the number of those
which stand prohibited by the popular or moral sanction.

An offence which is not accompanied with evil
consciousness is accompanied either with temerity: or with
blameless error. For by those terms may be designated the
three several states of in one or other of which in every case
the mind can not fail to be in respect of knowledge, or say
rather more properly belief is pernicious† † Rationale of Evidence Vol. 1. with reference to the bearing
of the law upon the act which it has converted into in which by its prohibition it has stamped the character of an offence.
