Prize. Proclamation 31 Jany 1805, analysed Observations
In the preamble the only states mentioned as liable to
have their vessels captured are 1. 12. Italian Republic
and Ligurian do: viz. under Proclamation Order in Council 17 Aug. 1803.
King of Spain, under do 12 Jany 1805.
In Col. 4, lines 25 to 28 mention is indeed made
of "captures" as liable to be "made from Roman and Pretorian
Republic. But this is only for the purpose of extending
to (viz. by the Proclamation) to such those captures, regulations
confused to the particular case of capture by covered Vessels
in the King's service.
Nor of this partial exclusion it in either this plan mention made
use intimation gives in the way of general reference.
Men have denied the matter at present in regard to the seven other
powers with which we are at war, viz.
1. Russia. 2. Denmark. 3. Prussia. 4. Austria. 5. Naples.

In line 83 mention is made of the same where "in case" (it is said) "any difficulty shall arise
in respect of to the said distribution, not herein sufficiently provided for" in which case reference is directed
to to under the Admiralty Board. In an What on this occasion is meant by
"the said distribution"? the whole pl scheme of distribution
contained in the proclamation, or only the there
last immediately preceding article of it case described in it?
3. In this vast mass of Letter-press consisting of 293
long lines though there is no division into Sections nor from
beginning to end, as much as a single mathematical figure from beginning to
end, there are a few and a very few breaks, viz such
as are constituted by making a particular line at its conclusion
a commencement fall short of the rest. But even in these
breaks there is more of deception and confusion than of construction. Then in several places, where a subject compleatly new is
begun upon there is
no break: and, on the
other hand, in the
middle of a subject
a break presents itself.
