Review.

That the number of those alledged services, and in consequence
of those fees might be rendered as great as possible it was
necessary that the suitors and the where they have any those of whom
testimony is or be productive of evidence in other
shapes they have need of should be kept as compleatly as
possible out of the presence of the Judge: that in the capacity
not of companions and guides conductors but that of go-betweens
those should be that in which the of services of those
assistants should be performed: and that the of those different
sorts of go-betweens the number should be as great, and the line
of them one behind another should be as great as possible.
For by every one of those go-betweens added, there was an
additional number of operations and an additional number
of instruments to be framed or dealt with was constituted.

On this occasion what does Mr Bentham? From first to last
he clears the court of all those Go-betweens. Guides where necessary,
says he – yes. Go-betweens
none.

Again. The more obviously and grossly repugnant
to the notions of men in general in respect of justice the decisions
of the Judges were, the greater would be and appears
to be what is called the uncertainty of the law: and the greater
the apparent uncertainty of the law, the more urgent the need which
men at large would feel themselves to have of the services
of those so essentially treacherous assistants. But to cover themselves if by those whom they thus
and this determination of theirs the policy of the Judges had been seen by those who were
constituted sufferer and understood, they would, in a rude
age have been torn to pieces: and if by to any man it was
possible to deserve to be torn to pieces such would have been the
desires of those same Judges. To keep the people from seeing
how they were betrayed and tormented, it was necessary that a
veil of obscurity as thick as possible should be thrown and
kept thrown over everything that was said and done: that
as the thieves have their so the lawyers should have
theirs. For this purpose, and with the best imaginable effect and in the best contrived and most successive means successful manner
this peculiar language was in the largest proportion of his: to which
that this most pernicious of misrepresentation might be
by being under the same name as those of
the , conniving
and instructive class
were called fictions:
whereas their proper
denomination was is that which Mr Bentham has given stuck to them – pickpocket lies.
