As to each of the several
matters of fact in dispute
after the chaos of special
pleading the Judge has
authority to send it to
a Jury
§.70 Of the "matters of fact" capable of being brought into
"dispute between the parties" a specimen has herein
above been brought to view. Now after the chaos
of special pleading upon our learned draughtsman speck
and spic and plan, by "estation," and "article," and
what not, has been carried on to a sufficient length
suppose a fancy taken by the Judges to see what would will
be said to them by a few sets of twelve men put respectively
into so many boxes, after hearing the requisite
declamations our style as near as may be to our learned
draughtsman's incomparable style, has at least on each
side? In this same §.70 to look further, his Worship
or Honour or Lordship in Ordinary will find authority for
so doing to his hearts content

In this case Reinquiry
the first to determine

Then In this case in the instance relation to each such matter of fact comes Reinquiry the second first, having for it the object
of it to determine whether Reinquiry the second, namely
the aforesaid Jury-trial as aforesaid: Reinquiry the
first being by Motion, stuffed with Affidavit work
in this as in all other cases. But every instance
of Jury trial will be found to suppose the existence of a
Motion for New trial, and in one of the two events, New
trial accordingly: then from those dates in regard to each
such disputable matter of fact, instituting in regard to each in the first place
the two enquiries included in the original Jury trial
as above, and then adding these two the two New Trial
enquiries we should have 4. This number 4 will then thereupon
have to be multiplied by the number of the above-
mentioned disputable matters of fact, for which it being
put :
