Expositive

Art. 4. In Art. 2. it was is declared the
end in view and business of the arrangements belonging to the Procedure
Code or say Adjective branch of the Pannomium is declared to be the giving execution and effect
in case of contestation in so far as contestation has place to the other branch that is to say
to the substantive. But moreover in so far as contestation
has place in relation to any this or that legislative arrangement
belonging to the Adjective Code itself execution and effect
must of course be given, to and by the same such arrangement on the same manner
as to any arrangement belonging to the substantive Code.

Art. 5 Service

Art. 5. In cases of contestation the mode in
which by those operations the performance of which is the business
of the this procedure Code or say of the Adjective branch of the law
execution and effect is on each occasion given to the portion
of substantive law f the execution of what which is by the
Pursuer demanded at the hands of the Judge will be different
According as that which the service demanded at his
hands is the collation of some right, at the charge of some defendant or the application
of the assortment of remedies provided by the substantive
<branch of the law for the alledged wrong which contestation has been
taken for the subject of the Pursuer's compliant.
