may be consider'd at two successive periods : before the event and
after. At the first period , the offence may be said to
rest in periculo : at the second it may be said to
subsist in gradu consummato .

Nusances may be distinguished into permanent &
transient. I call a nusance permanent when the
instrument of mischief runs is such as from the nature
of it's destination continues for a length of time in that
state which whether of motion or rest which qu disposes
it to produce the mischief . I call a nusance permanent
transient only when the nature of the instrument of
mischief is not such as from the nature of its destination continues
to for any length of time in that state .
