As to the persons whose interests are affected
by it, where, on the occasion of the transaction,
blame on the part of some person has place,
they may be distinguished into two classes – the
blameless and the blameworthy: for the
most part, it is upon the blameless that
the whole of the afflictive part of the consequences
had been made to fall. The
blameworthy are kept harmless from it, and
if they are not the authors of the affliction,
they are associates in respect of interest and
sympathy with those who are; and among them
share the profit of it.

To begin with the only case in which
the practice can have had any sufficient warrant
in point of justice, that is to say conformity
to the dictates of the disappointment-prevention
principle, and thereby to those of the
greatest happiness principle. This is the case
where the practice is among the exercises given
to the Legislative authority. In this case,
what the legislator says to the citizen is
speaking for example of a conveyance, in
the case in question, let your conveyance be
of one or other of the descriptions following,
referring at the same time to a list of them,
or it shall not and will not be productive
of the effect intended by it. The judge shall
not and will notdhd. occasion arrive, employ his authority in
giving effect to it. Here then, if the party
