1824. Feby. 10
Constitutional Procedure Code.Ch. Costs
Repeated in this case are the four evils above brought
to view in the case of the gratuitous substitute
But the evil consisting in the consumption of time
receives such an aggravation as may require warrant a separate
notice.
The gratuitous assistant has no motive inducement for giving
useless encrease to the quantity of time employed in transferring
in so far as capable of being transferred the
appropriate ideas from the mind of the principal to the mind of
his beneficent assistant. But the mercenary assistance has
inducement in abundance.
The party, in the statement he makes, whether to
his unpaid benefactor or to his heavily dearly paid agent
takes more liberty than he would have desired to
been permitted to take or would have desired to attempted to
take with the Judge. As to the benevolent and
beneficent substitute assistant, if so it be that his sympathy
engages him to bestow in more time on the hearing of it
more time than is necessary, no harm has place on
either side. Not so the mercenary assistant and substitute if it
be to his care that the statement is applied applies itself. True
it is that for every atom of this time the of his experienced
and skilled assistant and advisor and assistant the
party Client principal is doomed to pay at a dear no trifling rate. But in by the
pleasure gratification, experienced from the dear bought token semblance of sympathy
the client forgets forgets is rendered the agitated heated mind of the client is
turned aside from the price and the rate and the price
at which he pays for it.
