1823. Novr. 8
Constitutional Code
Art. 3 continued. An assertion by which the chances
in favour of the existence of a fact are represented represented and meant
to be regarded as being near to those in favour of its non-existence
in any degree of proximity is as susceptible of
being false and knowingly false, as an assertion by
which they are represented as being remote from equality
in any degree of remoteness.(a)
Note (a)
(a) Note, that, so many words and propositions positive negative in effect
are negative positive in form, and vice versâ, – that to distinguish
the one from the other is frequently no easy matter.
Reality and unreality existence and non-existence
are the attributes of alledged facts matters of fact: verity and falsity
of the assertions in relation to them.
In common speech the check done are eternally
confounded. We Men say a true fact and a false fact as
readily as a true assertion and a false assertion.
