Art. 8. If on the exhibition of a certain document,
its authenticity being supposed, it be clear to
the Judge that the demand on the Pursuer's side would
be established, at the same time that the adduction of it
will require a certain portion of delay or expense, or both,
he may at his discretion, decree provisionally in favor
of the demand assigning a certain term or say interval,
at the expiration of which, if the document
be not exhibited, the decree shall be considered
as reversed; reserving to himself the faculty of enlarging
it on adequate cause.
Art. 9. In such case, he may moreover give
execution and effect to such his decree on the
Pursuer's finding adequate security for restitution
and compensation in the event of the non-exhibitedness
or non-probativeness of such unexhibited
document.
Art. 10. So mutatis mutandis in the case where
it is on the Defendant's side that the need of the document
has place.
