Procedure Code

Art. For guiding guidance to the opinion of the Judge as between
the oral and epistolary mode of examination
the rules are those which follow

Art. 1. Exceptions excepted, employ in preference

to the collateral ends of justice, it is so to such a degree
that the quantity of indication of the evil correspondent and opposite to the
ends of justice to wit delay vexation and expence avoided
or regarded said to be greater than the evil in the shape of danger
of misdecision encreased, that is to say the evil correspondent and opposite to
the direct ends of justice.
